Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Postgram website and application (the "Service"), operated by Postgram. By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
2. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your credentials confidential and for all activity on your account.
3. Subscriptions & credits
The Service is offered on subscription and/or credit-pack models. Prices are displayed on the pricing page and are processed by Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and no pro-rata refund is offered, except where required by law.
4. AI-generated content
Postgram uses AI models to generate captions, carousels, stories and images based on your inputs. You are responsible for reviewing AI output before publishing and for ensuring it complies with applicable law and platform rules. Postgram does not guarantee accuracy, originality or fitness of AI output for a specific purpose.
5. Your content & licence
You retain ownership of the content you upload and of AI output generated in your workspace. You grant Postgram a worldwide, non-exclusive licence to host, store, transmit and display such content solely to operate the Service on your behalf (for example, to publish on Instagram or Facebook when you instruct us to).
6. Acceptable use
You agree not to use the Service to: violate any law or third-party rights; spam, harass or impersonate others; generate or publish content that is illegal, defamatory, sexually explicit involving minors, hateful, or that violates the policies of Instagram, Facebook or any other connected platform; reverse-engineer or attempt to bypass technical limitations; or build a competing service.
7. Third-party platforms
The Service integrates with Instagram and Facebook through Meta's Graph API. Your use of those platforms remains subject to Meta's own terms. We are not responsible for changes, downtime or restrictions imposed by third-party platforms.
8. Suspension & termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks security, legal exposure or platform reputation. You can terminate your account at any time. Sections that by their nature should survive termination will do so.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Postgram shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our aggregate liability shall not exceed the amount you paid to Postgram in the 12 months preceding the claim.
11. Indemnity
You agree to indemnify and hold Postgram harmless from any claim arising out of your content, your use of the Service or your violation of these Terms.
12. Changes
We may update these Terms occasionally. Material changes will be notified inside the app or by email at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction where Postgram is established, without regard to conflict-of-laws principles. Disputes shall be resolved in the competent courts of that jurisdiction.
